SCOPE OF APPLICATION

These General Terms and Conditions of Use (“GTC”) of Elvira Greblic (“seller”) shall apply to all contracts concluded between a consumer or a trader (“customer”) and the seller relating to all goods and/or services presented in the seller’s online shopelviragreblic.com. The minimum age for purchasing goods is 16. The inclusion of the client’s own conditions is herewith objected to, unless other terms have been stipulated. Such terms and conditions shall only apply if the parties have entered into a different written agreement. Elvira Greblic reserves the right to amend these GTC. The GTC applicable at the time the customer places an order applying to the sale and delivery of products.

CONCLUSION OF THE CONTRACT

The customer may submit the offer via the online order form integrated into the seller’s online shop. In doing so, after having placed the selected goods and/or services in the virtual basket and passed through the ordering process, and by clicking the button finalizing the order process the customer submits a legally binding offer of contract with regard to the goods and/or services contained in the shopping cart. The customer may also submit his offer to the seller by telephone, e-mail, postal service or per online contact form.

After placing your order we will send you an e-mail confirming receipt of your order and serves as the invoice for your purchase from elviragreblic.com. This order confirmation contains all details of your order (including products ordered, prices, delivery and payment conditions). When you receive your order confirmation, Elvira Greblic will also accept your order.

However, we reserve the right to revoke the acceptance of the purchase contract up to 24 hours after the confirmation email has been sent. This can e.g. be the case if the ordered goods exceed the normal household quantity or cannot be delivered.

The German and the English language are exclusively available for the conclusion of the contract.

Order processing and contacting usually takes place via e-mail and automated order processing. It is the Client’s responsibility to ensure that the e-mail address he provides for the order processing is accurate so that e-mails sent by the seller can be received at this address. In particular, it is the Client`s responsibility if SPAM filters are used, to ensure that all e-mails sent by the seller or by third parties commissioned by the seller with the order processing can be delivered.

CANCELATION

You have the right to cancel this contract within fourteen days from the conclusion of this contract. Please note that you do not have the right to cancel the contract if the products have been manufactured in accordance with your specifications or tailored to meet your own requirements and for sale items.

The cancellation period is fourteen days from the day on which you, or a third party named by you who is not the carrier, have or has taken possession of the goods or, in the event of partial deliveries, the day on which you, or a third party named by you who is not the carrier, have or has taken possession of the final goods.

In order to exercise the right to cancel the contract, you shall notify us (Elvira Greblic, Markgraf-Rüdiger-Straße 24/10, 1150 Vienna, Austria, mail@elviragreblic.com) with a clear declaration (e. g. a letter sent in the post or an email) of your decision to cancel this contract. You can, but do not have to, use the cancellation form template attached for this purpose.

In order to comply with the cancellation period, it is sufficient for you to send off the notification that you plan to exercise your right to cancel the contract before the cancellation period has expired.

Consequences of a cancellation

If you cancel this contract, we shall reimburse to you all payments previously received from you, including postage and packing (excluding the additional costs resulting from you having selected a type of delivery that differs from the lower-cost standard delivery offered by us), without delay and no later than within fourteen days from the day on which we receive the notification of your cancellation of this contract. We repay these amounts through the same means of payment you used for the original transaction, unless explicitly and otherwise agreed with you. You shall not be charged any fees for such reimbursement. We may refuse to reimburse your payments until we have received the returned goods or until you have provided proof that you have returned the goods, whichever the earlier.

You shall return, or hand over, to us the goods without delay, but never later than within fourteen days from the day on which you notify us of your cancellation of this contract. This deadline shall be deemed to have been complied with if you dispatch the goods before the fourteen-day period expires.

We shall carry the direct costs for returning the goods.

You shall only pay for a potential loss of value of the goods of this loss of value is caused by you handling then goods in an unnecessarily inappropriate manner in order to check its quality, properties and functions.

PRICES AND PAYMENT

All prices are stated in euros, depending on the chosen setting, include VAT and exclude postage and packing, unless otherwise stated.

The customer authorises Elvira Greblic to debit the respective purchase price of the products, including postage and packing, from the customer’s means of payment at the time a customer account is created or at the time of a confirmed order.

The purchase price plus postage and packing is authorised to be debited from the customer’s means of payment by Elvira Greblic when the customer places an order. The amount is only debited from the customer’s account once the order has been accepted with a confirmation of dispatch.

In the event of the customer defaulting on payment, 7% default interest p.a. shall be deemed to have been agreed. A fixed fee of EUR 15.00 is charged for payment reminders.

You can choose between different methods to pay for your order:

– Credit card (Visa, Mastercard, Diners Club, American Express)

This hides all your details from unauthorized persons, so that misuse of your personal data or credit card details can be excluded.

SHIPMENT AND DELIVERY CONDITIONS

We deliver across whole Europe with the exception of permanent or temporary restrictions by the Austrian Post. The delivery will be made to the delivery address you provided – unless otherwise agreed. All information on availability, shipping time or delivery are only guidelines and non-binding or guaranteed delivery dates. If the goods ordered are not available we reserve the right to withdraw from the contract and not deliver them. In this case you will be informed immediately. Elvira Greblic reserves the right to charge additional shipping costs, for example in the event of unsuccessful delivery or refused acceptance.

Should the assigned transport company return the goods to the Seller, because delivery to the Client was not possible, the Client bears the costs for the unsuccessful dispatch. This shall not apply, if the Client exercises his right to cancel effectively, if the delivery cannot be made due to circumstances beyond the client’s control or if he has been temporarily impeded to receive the offered service, unless the Seller has notified the Client about the service for a reasonable time in advance.

RESERVATION OF PROPRIETARY RIGHTS

If the Seller provides advance deliveries, he retains title of ownership to the delivered goods, until the purchase price owed has been paid in full.

WARRANTY

Elvira Greblic does not provide any warranty for defects caused by the customer’s information, drawings or individual requirements or materials provided by the customer.

No warranty shall be given in the following cases: Unsuitable or improper use, natural wear and tear, improper, incorrect or negligent handling or cleaning as well as unusual impacts.

In the event of a defect being covered by mandatory warranty, Elvira Greblic may repair or replace the products at its own discretion and at its own facilities. The customer shall carry the costs for returning the products.

The customer has the right to withdraw from the contract if the defect is material and Elvira Greblic fails to repair or replace the defective product within a period of grace of fourteen days.. If a defect is immaterial, the customer is only entitled to a reduction of the purchase price.

All elements (images, texts and other) of the website www.elviragreblic.com, as well as the associated social media pages (https://www.facebook.com/elviragreblic/ and https://www.instagram.com/elviragreblic/) are the intellectual property of Elvira Greblic. Links to this homepage are welcome. The use of images is also permitted, providing the source as a link (www.elviragrebliccom) and the author Elvira Greblic is explicitly mentioned in the publication. The copying or reproduction of parts of this page for other purposes (e.g. copying product texts, using text passages from frequently asked questions, etc.) is prohibited under all circumstances, unless Elvira Greblic has given its prior written consent.

10) Applicable Law

The law of the Republic of Austria shall apply to all legal relationships between the parties under exclusion of the laws governing the international purchase of movable goods. For consumers, this choice of law only applies to the extent that the granted protection is not withdrawn by mandatory provisions of the law of the country, in which the consumer has his habitual residence.

SEVERABILITY CLAUSE

In the event that individual points of these terms and conditions are / become fully or partially ineffective, the validity of the remaining points remains unaffected.
